CCPC Invites Views on Simplified Merger Notification Procedure Guidelines

The Competition and Consumer Protection Commission (CCPC) has commenced a consultation seeking views from industry stakeholders on draft simplified merger notification procedure guidelines. This consultation follows the announcement in June that the CCPC has decided to introduce a simplified procedure for certain notifiable mergers or acquisitions.
The draft guidelines, which are informed by the views of an earlier consultation, provide a detailed overview of the conditions that must be satisfied for a merger or acquisition to fall within the scope of the simplified merger notification procedure. They also set out the procedural provisions including: pre-notification discussions, the notification and publication of a transaction and the determination process under the simplified merger notification procedure.
It is intended that the introduction of a simplified merger notification procedure will have a positive impact on businesses, as review periods for mergers or acquisitions which do not raise significant competition concerns will be shorter, and the Irish merger control regime will be less burdensome for notifying parties.
The purpose of this public consultation is to invite the views of interested observers on the ‘Simplified Merger Notification Procedure Guidelines’. In responding to this consultation, we request that you identify the relevant section and paragraph number before providing your comments and feedback.
